2. Platform Services and Algorithmic Trading

Pevna Uctarna provides software-as-a-service utilities designed to run mathematical models, automate trade execution via user-connected third-party brokerages or digital asset exchanges, and offer automated risk assessment parameters. You expressly understand and agree that:

• Pevna Uctarna is a technology provider, not a regulated bank, custodian, registered investment advisor, or broker-dealer.
• We do not take custody of your fiat currency or digital assets. Trades executed via integrated application programming interfaces (APIs) take place directly on third-party venues chosen and connected by you.
• Our tools do not generate guarantees of profit, yield, or protection against loss. Past simulated or actual performance generated by algorithms does not predict future performance.

3. User Account Security and Responsibilities

You are exclusively responsible for maintaining the confidentiality of your login credentials, API secret keys, two-factor authentication tokens, and any session data associated with your account. You agree to notify Pevna Uctarna immediately of any suspected unauthorized access or compromise. Under no circumstances will Pevna Uctarna be held liable for losses or damages resulting from unauthorized activity occurring under your authenticated profile.

4. Acceptable Use Policy

When using our Platform, you agree not to engage in any prohibited activities, including but not limited to:

• Reverse engineering, decompiling, disassembling, or extracting the underlying source code of our algorithms or analytical systems.
• Engaging in market manipulation, wash trading, front-running, or other unlawful market behaviours through connected accounts.
• Attempting to bypass security infrastructure, rate limits, or network protection systems.
• Deploying automated scrapers, web spiders, or automated queries without our explicit prior written consent.

5. Fees and Subscription Terms

Certain components, tools, or computational tiers within the Platform may require paid subscription access or software usage fees. All applicable fee structures, recurring payment cadences, and billing schedules are disclosed prior to activation. All payments made are non-refundable except where expressly required under relevant consumer protection law in the United Kingdom. We reserve the right to revise subscription fees upon providing reasonable advance notice.

6. Intellectual Property Rights

All software code, graphic interfaces, trademarks, platform text, data models, logic structures, and documentation are the exclusive intellectual property of Pevna Uctarna or its licensors. You are granted a revocable, non-exclusive, non-transferable, limited licence to use the Platform strictly in accordance with these Terms for your personal or authorized internal business purposes.

7. Limitation of Liability and Disclaimers

To the maximum extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, statutory, or implied. Pevna Uctarna explicitly disclaims any warranties of merchantability, fitness for a particular purpose, uninterrupted uptime, or error-free algorithmic execution.

In no event shall Pevna Uctarna, its directors, employees, affiliates, or service partners be liable for any indirect, consequential, punitive, exemplary, or financial losses (including lost profits, loss of data, trade slippage, or exchange outages) arising out of or related to your use of or inability to use the Platform.

8. Governing Law and Dispute Resolution

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by, and construed in accordance with, the laws of England and Wales. Any dispute, claim, or controversy arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts situated in the United Kingdom, unless alternative amicable arbitration is agreed upon by both parties.
